Company: Teleweb Inc. ("Teleweb," "we," "us," or "our")
Welcome to Teleweb. These Terms of Service ("Terms") constitute a legal contract governing your access to and use of our services across all current and future deployments. This includes our mobile apps (iOS, Android), websites, television applications (tvOS), and console integrations (including but not limited to PlayStation, Xbox, and Nintendo ecosystems) (collectively, the "Platform").
By creating an account, connecting hardware, or purchasing time slots, you agree to these Terms. If you do not agree, you are strictly prohibited from using the Platform.
1. Definitions and Account Tiers
The Platform categorizes registered accounts into three distinct user roles, each with specific interactive rights:
- "Spectator" (Non-Paying User): A registered user who can view live streams, submit comments, and issue "likes" on active vehicle feeds without financial charge. Spectators do not have access to two-way audio communication functions.
- "Player" (Paying User): A registered user who purchases time credits to remotely operate an Unmanned Ground Vehicle (UGV) via our low-latency peer-to-peer data stream. Players possess all Spectator privileges and are additionally authorized to use the device audio functions and rate sessions upon completing a drive.
- "Host" (Device Owner): A user who registers, owns, and deploys a Teleweb-Porter controller hardware device connected to an Unmanned Ground Vehicle (UGV).
- "Teleweb-Porter" means the proprietary internet-based microcontroller and related physical peripheral equipment sold by Teleweb Inc.
2. User Accounts, Minimum Age, and Verification Authenticity
- Strict Minimum Age Requirement: You must be at least 13 years of age to access our services or register for an account on the Platform as a Spectator, Player, or Host. Any profile discovered to be created by an individual under the age of 13 will be terminated instantly without prior notice.
- Truthfulness Mandate: You undertake and guarantee that all user registration information, identification records, and corporate tax qualifications you provide are true, accurate, complete, and timely.
- Right to Refuse: Teleweb Inc. retains the absolute right to refuse service, suspend active streaming profiles, or freeze payout distribution pipelines instantly if any details provided are discovered to be fraudulent, outdated, or un-verifiable.
- Account Custody: Accounts are strictly personal. You are prohibited from selling, leasing, lending, or transferring control of your account credentials or linked hardware identity markers to any third party.
3. Intellectual Property Protection & User Content License
- Platform Ownership: All content present on the Platform—including but not limited to text, images, interface graphics, user dashboard designs, corporate logos, video layouts, live stream overlays, and underlying database software—is the exclusive property of Teleweb Inc. or its designated licensors.
- User Content Grant: For any data, text comments, or driving footage clips you record, upload, or transmit through our platform features, you grant Teleweb Inc. a worldwide, limited, non-exclusive, royalty-free, sub-licensable license to host, format for optimal display, store, copy, and distribute said material exclusively within the platform community functions. This license terminates the moment your user content is permanently deleted from the ecosystem.
4. Communications & Email Subscriptions
- Consent to Receive: By creating an account and registering on our Platform as a Spectator, Player, or Host, you provide your explicit consent to receive electronic communications from Teleweb Inc.
- Scope of Messaging: Communication channels will be utilized to transmit essential operational service updates, hardware patch notifications, transactional digital receipts, security alerts, and promotional marketing materials regarding new product releases or peripheral hardware sales.
- Opt-Out Mechanisms: Users may manage their communication preferences or choose to opt-out of promotional marketing emails at any time by clicking the "Unsubscribe" hyperlink embedded at the footer of our marketing emails or by modifying their profile configuration within the app settings. Critical system-wide security, account recovery, or billing updates are mandatory and exempt from standard opt-out channels.
5. Player Financials & Estimated Operational Credits
Players access active hardware on the platform by choosing one of four distinct, prepaid account Top-up packages. Time balances are allocated as Estimated Operational Credits:
- Base Package: Provides an estimated 1 hour of active driving time.
- Duo Package: Provides an estimated 2 hours of active driving time.
- Quad Package: Provides an estimated 4 hours of active driving time.
- Quad with Auto-Topping: Provides an estimated 4 hours of active driving time, with automatic replenishment of an estimated additional 4 hours when the balance reaches zero.
Network Connection and Credit Fluctuation
- Variable Session Timing: You acknowledge that driving credits are consumed dynamically. Due to internet routing variations, packet loss, signaling delays, or frequent entering and exiting of active driving sessions, the platform cannot guarantee down-to-the-second precision (e.g., exactly 3,600 seconds per hour).
- Strict Non-Refundability Policy: All Top-up package purchases, credit deposits, and remaining account balances are completely non-refundable. If a user requests permanent deletion of their account, any remaining balance or time credit is forfeited and will not be refunded or converted to cash.
6. Host Earnings, Payouts, & Financial Structures
Hosts monetize their physical UGV assets through the platform under clear, preset financial structures managed entirely by Teleweb.
Earning Tiers & Ratios
- Base Revenue Split: Hosts earn based on their vehicle’s listed hourly rates. The standard baseline earnings tier fluctuates between 42% and 50% of the gross session cost.
- Dynamic Adjustments: Listed hourly rates are subject to seasonal discounts, platform promotions, and user coupons applied at checkout. Host payout calculations adapt proportionally to these promotional adjustments.
- Earning Boosts: Hosts may leverage the Teleweb Affiliate Program (detailed in Section 9) to dynamically scale their active payout percentage up to a maximum threshold of 70%.
- Visibility: Net estimated weekly earnings are updated dynamically and made visible within the Host's profile dashboard.
Automated Disbursement Terms
- Zero Transaction Fees: Teleweb absorbs all transaction and transfer processing fees. Hosts do not bear any point-of-sale or payout processing deductions.
- Weekly Payout Window: Automated payouts are disbursed exclusively via PayPal Payouts on Thursdays at 10:30 AM (UTC -6).
- Minimum Threshold: A strict $100.00 USD minimum balance is mandatory for automated disbursement.
- Roll-Over Terms: Any funds, earnings, or balances falling below the $100.00 threshold or deemed ineligible for transfer due to account limits will securely remain in the Host's digital profile until the next regular Thursday disbursement window.
Host Self-Driving Rights & Monetization Safeguards
- Unlimited Free Self-Driving: Hosts retain the right to remotely operate their own connected vehicles through their own Host profile completely free of charge and without any structural time limits.
- Anti-Circumvention Clause: This self-driving feature is strictly for the individual account holder. Hosts are explicitly prohibited from sharing their account access with external users to bypass the Teleweb monetization engine. Prohibited sharing methods include, but are not limited to: physical device access sharing, remote desktop utilities, live screensharing with secondary input pass-through, or any other digital or mechanical workaround designed to let another individual operate the vehicle for free. Any discovered bypass attempt will lead to immediate, permanent hardware deactivation.
7. Code of Conduct, Safety, & Permanent Banning
The Platform operates strictly as a safe, family-oriented environment for entertainment. It is designed and optimized for EVERYONE 10+ (ESRB) / PEGI 12 audiences.
Operational Limits & Mandatory Supervision
- Closed & Controlled Environments Only: The Teleweb-Porter is designed strictly for closed, controlled physical environments. Hosts must maintain continuous, active personal supervision of their physical devices at all times.
- Prohibited Areas: Operating or exposing a Teleweb-Porter equipped vehicle in open public areas, municipal parks, crowded spaces, or public roads is strictly prohibited.
Live Hardware Audio & Language Behavior
- Voice and Text Moderation: Players and Hosts have access to real-time voice streaming via the Teleweb-Porter’s physical built-in microphone and speaker. All users must keep communication civil and clean.
- Zero Tolerance: Profanity, screaming, hate speech, threats, or harassment over text comments, rating reviews, or the physical device audio stream will trigger immediate moderation action.
- Consecutive Reporting: Receipt of consecutive or systemic negative reports regarding a user's behavior or voice conduct will trigger an immediate human review and systemic lockout.
- Permanent Account and Device Bans: Any violation of safety, location limits, anti-circumvention rules, or audience behavior ratings will result in the permanent suspension and banning of both the user profile account(s) and all linked Teleweb-Porter physical hardware device(s).
Complete Forfeiture of Assets Upon Ban
- No Credit Disbursement: If an account is banned, any remaining driving credits, pending balances, or due Host earnings within that account are completely frozen, permanently forfeited, and will not be refunded or disbursed under any circumstances.
- Hardware Return Ineligibility: Teleweb-Porter physical units associated with a banned, suspended, or blocked account are completely ineligible for commercial return, repair, or retail refund.
8. Interaction & Feedback Engine
- Likes and Comments: Spectators, Players, and Hosts may utilize interactive engagement tools (likes and comments) to build community presence. Teleweb reserves the right to automatically filter or restrict text inputs that violate community standards.
- Session Ratings: Only verified Players who have paid for and completed an operational drive session may leave star or numerical ratings for a Host's vehicle. Artificial review manipulation or rating coordination among users is grounds for banishment.
9. Affiliate Marketing Program Terms
Participation in the Teleweb Affiliate Program is a privilege designed to maximize community reach, subject to strict fair-use parameters.
- Discretionary Approval: Teleweb reserves the right to approve, reject, or suspend ANY Affiliate Program Registration at our sole and absolute discretion. Applicants have no legal recourse against Teleweb Inc. for registration rejections.
- Self-Referral Prohibition: Deploying or executing self-referrals to manipulate payout structures is forbidden. Accounts tracking more than three (3) self-referrals will be automatically disabled without warning.
- Fair Use Review: Every single referral transaction is governed by a strict fair use policy. Teleweb retains the right to audit, lock, or review each individual referral order prior to authorization.
- Cookie Tracking Limitations: Referrals are tracked exclusively via browser and application cookies. If an end-user blocks cookies, clears cache files, uses cookie-blocking security extensions, or explicitly denies tracking permissions, Teleweb cannot map the sale to the Affiliate and cannot pay earnings or commissions on that untracked user activity.
10. Affiliated Third-Party Links Disclaimer
- External Framework Routing: The Platform or Affiliate Network portals may display hyperlinks pointing to external websites, independent ecommerce platforms, or services owned and operated by third parties.
- Complete Separation of Liability: Teleweb Inc. maintains no operational control over, and assumes zero legal responsibility for, the structural content, accuracy, reliability, privacy protection protocols, data harvesting setups, or terms of use implemented by any external third-party digital channels. Navigating to external domains is performed entirely at your own corporate and individual risk.
11. Technical Disclaimers & System Limitations
- "As-Is" Service Delivery: The platform infrastructure, software layers, and streaming pipelines are provided strictly on an "As-Is" and "As-Available" basis.
- No Warranties: Teleweb Inc. provides zero expressed or implied warranties regarding system uptime, network packet delivery, network latency, or continuous, uninterrupted low-latency peer-to-peer data connectivity.
12. Full Indemnification Clause
You explicitly agree to defend, indemnify, and hold completely harmless Teleweb Inc., its parent holding entities, board directors, engineering staff, and manufacturing affiliates from and against any third-party claims, liabilities, financial damages, financial losses, costs, or expenditures (including reasonable defense attorney fees) arising directly or indirectly out of:
- Your explicit breach or violation of any clause contained within these Terms.
- Your unsafe installation, battery management, or dangerous operational deployment of the physical Teleweb-Porter unit.
- Infringement by your user-uploaded comment streams or media clips upon the privacy or intellectual property rights of any external individual.
13. Limitation of Liability Maxima
To the absolute extent permitted under applicable municipal laws, Teleweb Inc. shall not be held liable for any indirect, incidental, punitive, special, exemplary, or consequential financial damages, or any loss of active business data, hardware fleet profits, or network reputation metrics. In no event shall Teleweb’s comprehensive liability for all marketplace claims exceed the total net cash sum paid by you directly to Teleweb Inc. during the immediate three (3) month window preceding the initialization of the legal dispute.
14. Dispute Resolution & Binding Individual Arbitration
- Informal Negotiation Mandatory: Prior to filing a formal claim, you agree to submit your dispute to our corporate support pipeline via written notice to resolve the discrepancy amicably.
- Arbitration Mandate: If an agreement cannot be established within sixty (60) days, all ongoing conflicts will be settled through binding, individual arbitration managed under the commercial rules of the American Arbitration Association (AAA).
- Class Action Waiver: You explicitly waive your rights to maintain or participate in collective class action lawsuits, representative public litigations, or consolidated multi-party structural claims against Teleweb Inc.
15. Governing Law and Venue Jurisdiction
These Terms, along with your software interaction and hardware deployment profile parameters, are governed and construed entirely in accordance with the internal statutory laws of the State of Texas, United States, without regard to conflict of law metrics. Any legal actions or corporate proceedings not matching standard arbitration clauses must be exclusive to state or federal courts physically situated in Fort Bend County, Texas.
16. Term Adjustments & Right of Amendment
Teleweb Inc. reserves the baseline corporate right to update, re-word, or alter these Terms at any time due to shifting regulatory conditions, console developer requirements, or hardware framework expansions. Altered versions will be deployed on this page with an updated effective timestamp. Continued interaction with our mobile systems or hardware activation pipelines post-deployment constitutes your binding legal acceptance of the modifications.
17. Severability & Entire Agreement Integration
If any specific clause, sub-section, or legal sentence within these Terms is found to be unlawful, void, or structurally unenforceable by an authorized judicial arbitrator, that narrow component shall be severed cleanly from the contract without impacting the legal validity and binding enforceability of the remaining sections. These Terms represent the final, complete, integrated agreement between you and Teleweb Inc.
18. The Teleweb Founders' Promise
At Teleweb Inc., we view our network of hosts and players as partners. Teleweb Inc. solemnly promises to continuously iterate our operational models to maximize the Host owner's long-term income rate while systematically minimizing player usage fees as much as physically and structurally feasible over time.
